NYS is definitely interested in this option being implemented. We have done some preliminary research and found some states currently allow the use of "X" as a non-binary option on their birth certificates. Here is the current listing of states that we were able to find that allows the use of "X": California, Colorado, Connecticut, Illinois, Main, Nevada, New Jersey, New Mexico, New York, Oregon, Rhode Island, Utah, and the District of Columbia.
